1.1 Information on our website about how you can enter the Competition and the Prize form part of these Terms.
1.2 By entering the Competition you accept these Terms.
2.1 You can enter the Competition only on our website.
2.2 Each day during the month of February 2008 GMT, you can click on up to 6 of the 16 images displayed on the homepage of our website. Each image has 1, 2, 4, 6 or 8 points hidden behind it. These points are randomly presented.
2.3 At the end of the month, each point you have earned gives you one entry in a random draw to win the Prize.
2.4 You can first enter the Competition at the start of, or any later time in, the month but, regardless of when you first enter, you will only be given as many entries in the random draw as points you have earned during the month. If you do not click on 6 images in any one day, any unused clicks will not be carried over into subsequent days.
2.5 By way of simple example, if you earn 8 points, 6 times a day, on each of 15 of the days in February, and earn 6 points, 5 times a day on 11 of the remaining 13 days in February, you will be given 1050 entries in the random draw to win the Prize.
3.1 You may enter the Competition only if:
3.2 If you are, or are an immediate family member of, a director, shareholder, or adviser of, or contractor to, iYomu, you are not eligible to enter the Competition.
4.1 The Competition period commences at 00:00:00 GMT on 1 February 2008 and closes at 23:59:59 GMT on 29 February 2008.
5.1 The winner of the Competition will be drawn, at random, at 12:00:00 GMT on 1 February 2008 at Level 8, 242 Queen Street, Auckland, New Zealand. The draw will take place under the supervision of an independent person of standing in the New Zealand community.
5.2 The first valid entry drawn will win the Prize. Judges' decision is final and no correspondence will be entered into.
5.3 We reserve the right to refuse awarding the Prize to any person whom we, in our sole discretion, determine has breached these Terms, gained unfair advantage in participating in the Competition, or obtained a winner status by fraudulent means.
6.1 The name of the winner of the Competition will be published on our website on 1 February 2008. If you are the winner, you will be notified via your iYomu email account.
7.1 If the winner does not claim the Prize within 10 working days of the announcement of the winner, the Competition may be declared null and void at the discretion of the directors of iYomu.
8.1 If you are the winner, the Prize will be paid as a single sum into your nominated bank account. If the Prize is converted into a currency other than US dollars, the exchange rate will be the rate that applies on the day of payment.
9.1 If you are the winner, you agree that we may use your name and photograph in any media as part of the announcement of the winner and for future promotional, marketing and publicity purposes, without any further reference, payment or other compensation to you, and you agree to make yourself available for this purpose.
10.1 We accept no liability for late, lost or misdirected entries.
10.2 You are to bear any costs you personally incur by entering the Competition.
10.3 To the maximum extent permitted by law, we shall not be liable to you or any other person for any direct, indirect, punitive, incidental, special, consequential or other damages whatever or however arising out of or in anyway connected with the Competition or the Prize.
10.4 If, for any reason, the Competition is not capable of running as planned, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond our control, that corrupts or affects the administration, security, fairness, integrity or proper conduct of the Competition, we reserve the right, in our sole discretion to cancel, modify or suspend the Competition, or to disqualify any individual who tampers with the entry or Competition process.
10.5 We assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries to the Competition. We are not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, failure of any email or entry to be received by us on account of technical problems or congestion on the internet or at any website, or any combination of them, including any injury or damage to any entrant's or any other person's computer related to or resulting from participation in the Competition.
11.1 The promoter of the Competition is iYomu.
12.1 These Terms are governed by and construed in accordance with New Zealand law. By entering the Competition you submit to the non-exclusive jurisdiction of the courts of New Zealand.
13.1 In these Terms, unless we say otherwise:
13.1.1 "Competition" means the iYomu February Cash Grabber Competition described in these Terms and elsewhere on our website;
13.1.2 "My Profile" means "My Profile" means the personal profiling tool found at http://www.iyomu.com/iyomuprofile;
13.1.3 "our website" means www.iYomu.com;
13.1.4 "Prize" means US$1,000.00;
13.1.5 "Terms" means these terms and conditions of entry, as they may be amended or varied by the directors of iYomu, in their sole discretion, from time to time and at any time;
13.1.6 "we", "us", "our" or "iYomu" means iYomu Limited, company number 1770827, having its registered office and address for service at Level 8, 242 Queen Street, Auckland, New Zealand;
13.1.7 "you" means each user of our website who enters the Competition.
